CLASS ACTION SETTLEMENT UPDATE: 7/9/2021

Status Report to Class Members

On April 3, 2015, the Court entered Judgment in favor of the Settlement Class against Your Neighborhood Urgent Care LLC (YNUC) and Dr. Robert Amster on the approved class action settlement. YNUC and Dr. Amster have not made any payments towards the Judgment.

On August 2, 2017, six of the YNUC-managed urgent care facilities filed for Chapter 11 bankruptcy, namely Cypress Urgent Care; Hoag Urgent Care – Anaheim Hills; Hoag Urgent Care – Huntington Harbour; Hoag Urgent Care – Orange; Hoag Urgent Care –Tustin; and Laguna Dana Urgent Care.  Also, several months later, on November 17, 2017, YNUC filed for Chapter 11 bankruptcy. (See, USDC, Cal. Central Bk. Court Case # 8:17-bk-14545). The secured creditors, with priority over the Class Action judgment lien, took all of YNUC’s recoverable assets, leaving nothing for other creditors from the bankruptcy estate.

In addition, US Bank/Nationstar Mortgage foreclosed on Dr. Amster’s residential property, taking his home, and leaving no excess funds available for payment towards the Class Action Judgment lien.
